In recent years, marriage relations between Vietnamese citizens and foreigners have been increasing considerably. As a result, divorce cases involving foreign elements also tend to increase, so the basis for terminating that marital relationship according to Vietnamese law is as follows:

Article 127 of the Law on Marriage and Family 2014 stipulates Divorce involving foreign elements.

“Divorce between a Vietnamese citizen and a foreigner, between two foreigners permanently reside in Vietnam shall be settled at the competent Vietnamese authorities in accordance with this Law.

In case a partner being a Vietnamese citizen does not permanently reside in Vietnam at the time of request for divorce, the divorce shall be settled in accordance with the law of the country where the husband and wife permanently co-reside; if they do not have a place of permanent co-residence, the Vietnamese law shall The settlement of a divorced couple’s immovables in a foreign country must comply with the law of the country where such immovables are located..”
– Regarding jurisdiction: According to provisions in Point a, Clause 1 of Article 37 of the CPC 2015 and Article 39 of the CPC 2015 regarding jurisdiction of territorial courts, the jurisdiction to settle divorce cases having foreign elements belong to authority of the provincial People’s Court where the defendant resides and works.

In case of divorce between Vietnamese citizens and citizens of neighbouring countries residing in the border areas, they shall be settled by the district-level People’s Court where Vietnamese citizens reside.

The litigants can also agree on the court where the plaintiff is residing and working to resolve. In case of divorce by mutual consent, the jurisdiction of the Court could be one of the parties agreed to divorce.

If one party does not know the working place or residence of the other party, based on Point a and c, Clause 1, Article 40 of the CPC 2015, the plaintiff has the right to choose the Court to resolve disputes of civil, marriage and family, business, trade, labor in the following cases:

“If the plaintiff does not know where the defendant resides or works or where his/her head-office is located, the plaintiff may petition the Courts of the area where the defendant last resides or works or where the head office of the defendant is last located or where the defendant’ properties are located to settle the case;
If the defendant does not have residence place, workplace or head-office in Vietnam or the case is related to disputes over alimonies, the plaintiff may petition the Court of the area where he/she resides or works to settle the case;”

In conclusion, the plaintiff has the right to choose a competent Court to resolve.

Resolving the divorce by mutual consent can last from 1 to 4 months. In some cases such as absent defendants, common property disputes, unilateral divorce cases which have to be resolved through two levels, this time may be extended.
Besides, the divorce between a Vietnamese citizen and a foreigner also arises relations about common children, common property, and common debt during the marriage period to solve in the right order, procedures and authorities, which requires the parties to understand the provisions of the law to ensure their best rights and legitimate interests.

CÔNG DÂN VIỆT NAM VỚI NGƯỜI NƯỚC NGOÀI

Trong những năm gần đây, các quan hệ về hôn nhân giữa công dân Việt Nam và người nước ngoài ngày càng có xu hướng gia tăng. Kéo theo đó, các vụ việc ly hôn có yếu tố nước ngoài cũng có chiều hướng tăng theo vậy căn cứ để chấm dứt quan hệ đó theo pháp luật Việt Nam như sau:
Điều 127 Luật Hôn nhân và Gia đình năm 2014 quy định Ly hôn có yếu tố nước ngoài.

“Việc ly hôn giữa công dân Việt Nam với người nước ngoài, giữa người nước ngoài với nhau thường trú ở Việt Nam được giải quyết tại cơ quan có thẩm quyền của Việt Nam theo quy định của Luật này.

Trong trường hợp bên là công dân Việt Nam không thường trú ở Việt Nam vào thời điểm yêu cầu ly hôn thì việc ly hôn được giải quyết theo pháp luật của nước nơi thường trú chung của vợ chồng; nếu họ không có nơi thường trú chung thì giải quyết theo pháp luật Việt Nam.

Việc giải quyết tài sản là bất động sản ở nước ngoài khi ly hôn tuân theo pháp luật của nước nơi có bất động sản đó”.

Về thẩm quyền giải quyết theo quy định tại Điểm a, Khoản 1 Điều 37 BLTTDS 2015 và Điều 39 BLTTDS 2015 về thẩm quyền của Tòa án theo lãnh thổ thì thẩm quyền giải quyết các vụ việc ly hôn có yếu tố nước ngoài thuộc thẩm quyền của Tòa án nhân dân cấp tỉnh nơi mà bị đơn cư trú và làm việc.
Trường hợp ly hôn giữa công dân Việt Nam và công dân nước láng giềng cư trú ở khu vực biên giới thì do Tòa án nhân dân cấp huyện nơi cư trú của công dân Việt Nam giải quyết.

Các đương sự còn có thể thỏa thuận Tòa án nơi mà nguyên đơn đang cư trú và làm việc để giải quyết. Trường hợp ly hôn thuận tình thì thẩm quyền giải quyết thuộc Tòa án của một trong các bên thuận tình ly hôn.

Nếu một bên không biết được nơi làm việc hay cư trú của phía bên kia thì căn cứ Điểm a, c Khoản 1 Điều 40 BLTTDS 2015 nguyên đơn có quyền lựa chọn Tòa án giải quyết tranh chấp về dân sự, hôn nhân và gia đình, kinh doanh, thương mại, lao động trong các trường hợp sau.

“Nếu không biết nơi cư trú, làm việc, trụ sở của bị đơn thì nguyên đơn có thể yêu cầu Tòa án nơi bị đơn cư trú, làm việc, có trụ sở cuối cùng hoặc nơi bị đơn có tài sản giải quyết;
Nếu bị đơn không có nơi cư trú, làm việc, trụ sở ở Việt Nam hoặc vụ án về tranh chấp việc cấp dưỡng thì nguyên đơn có thể yêu cầu Tòa án nơi mình cư trú, làm việc, có trụ sở giải quyết;”

Theo đó, nguyên đơn có quyền lựa chọn một Tòa án có thẩm quyền để giải quyết.

Về thời gian giải quyết thuận tình ly hôn khoảng từ 1 đến 4 tháng. Trong một số trường hợp như bị đơn vắng mặt, có tranh chấp tài sản chung, vụ án đơn phương ly hôn được giải quyết qua hai cấp thì thời gian này có thể được gia hạn thêm.
Bên cạnh đó việc ly hôn giữa một bên là công dân Việt Nam và một bên là người nước ngoài còn phát sinh những quan hệ về con chung, tài sản chung, nợ chung trong thời kì hôn nhân để giải quyết theo đúng trình tự, thủ tục, thẩm quyền đòi hỏi các bên phải nắm rõ các quy định của pháp luật nhằm bảo đảm tốt nhất quyền và lợi ích hợp pháp của mình.
