The ILRs is a must for an enterprise employing 10 employees or more.
The ILRs must include the following main contents:
- Working hours and rest breaks;
- Rules and order in the enterprise;
- Occupational safety and hygiene in the workplace;
- Protection of assets and confidentiality of technology and business secrets of the enterprise (from 1 May 2013, a new circumstance is added i.e. intellectual property of the employer);
- Conducts which are in breach of labour discipline and labour discipline forms imposed for those breaches, and responsibility for damage.
The enterprise must register the IRLs with the local Department of Labour, War Invalids and Social Affairs (“DOLISA”) or Board of Management of Industrial Zones, Processing Zones, Economic Zones or Hi-tech Zone (BOM) in case where the enterprise was established in these zones. The IRLs shall be effective as from the date of its registration.
