An employee who breaches the IRLs shall, depending on the seriousness of the breach, be dealt with on one of the following forms:
- Reprimand;
- Extension of the period for wage increase to no more than 06 months or transfer to another position with a lower wage for a maximum period of 06 months, or removal from the position (Note that form 1 May 2013, the form of labour discipline of transfer to another position with a lower wage for a maximum period of 06 months was cancelled); or
- Dismissal
Dismissal is the most serious labour discipline to the employee which may be applied in only following circumstance:
- Where an employee commits an act of theft, embezzlement, disclosure of business or technology secrets, or other conduct which is seriously detrimental to the assets or wellbeing of the enterprise (from 1 May 2013, some of other circumstances are added, inclusive of gambling, intentionally causing injury, using drug within the workplace, intellectual property infringement of the employer, threatening to cause extremely serious damage to the property and interests of the employer);
- Where an employee who is disciplined by extension of period for wage increase of transfer to another position re-commits an offence during the period when he is on trial or re-commits an offence after he is discipline in the form of removal from office (from 1 May 2013, the circumstance of transfer to another position is revoked); or
- Where an employee takes an aggregate of 05 days off in 01 month or an aggregate of 20 days off in one year on his own will without proper reasons.
