Service 1: Obtaining work permit and visa card  

1. Obtaining work permit

  • Providing a list of documents required for obtaining the work permit;
  • Drafting and preparing necessary documents to apply for a work permit;
  • Reviewing the relevant documents provided by the Client and the foreign employee to ensure the legality thereof;
  • Guiding the foreign employee to have an appropriate medical check-up;
  • Representing the Client to work with the local labour authorities;
  • Submitting the dossier for application for work permit to the Vietnamese competent authority and monitoring the progress of issuance of the work permit; and
  • Obtaining the work permit and deliver it to the Client.

 

2. Obtaining a temporary residential card for the new foreign labour

Upon the issuance of the work permit, the foreign employee may obtain a temporary resident card with the term equivalent to the term of the work permit which will replace the working visa of the foreigner for his/her entry into Vietnam. VDD LAWYERS will assist in carrying out legal procedures for obtaining the temporary resident card for the foreigner as follows:

  • Providing a list of documents required to obtain the temporary resident card;
  • Drafting and preparing necessary documents to apply for the temporary resident card;
  • Submitting the dossier for registration of the temporary resident card to the Vietnamese competent authority and monitoring the progress of issuance of the temporary resident card; and
  • Receiving the temporary resident card and deliver it to the Client.

 

Service 2: Drafting or reviewing and registering the Internal Labour Regulations and/or the Collective Labour Agreement

Step 1: Drafting or reviewing the Internal Labour Regulations and/or the Collective Labour Agreement

  • Collecting relevant information from the Client;
  • Drafting the new Internal Labour Regulations (“ILRs”) and/or Collective Labour Agreement (“CLA”) or reviewing the current content of the ILRs and/or CLA in Vietnamese to ensure its compliance with the current labour law and sending them to the Client for comments and inputs (if any);
  • Based on the Client comments (if any), finalizing the draft version of the revised version of the ILRs and/or CLA in Vietnamese;
  • Translating the final Vietnamese version of the ILRs and/or CLA into English for the Client information (if requested) and sending them to the Client; and
  • Once the final version of the ILRs and/or CLA are approved by the local labour authority in Step 2 below, translating the approved Vietnamese version of the ILRs and/or CLA into English for the Client information (if requested) and sending them to the Client.

 

Step 2: Registering the Internal Labour Regulations and/or the Collective Labour Agreement

  • Drafting required documents for registration of the ILRs and/or CLA with the competent State authority;
  • Submitting the application file and the revised ILRs and/or CLA to the local labour authority;
  • Revising the draft ILRs and/or CLA based on recommendations from the competent State authority, if any;
  • Following up with the competent State authority until obtaining formal approval of the ILRs and/or CLA; and
  • Finalising the English version to ensure its consistency with the final version in Vietnamese of the ILRs and/or CLA (approved one).
